Under the Agriculture and Agri-Food Administrative Monetary Penalties Act and Regulations, the Canadian Food Inspection Agency (CFIA) may issue an Administrative Monetary Penalty (AMP) as an enforcement measure to encourage compliance with the Health of Animals Act and the Plant Protection Act and their associated regulations.
An Administrative Monetary Penalty (AMP) can be either a notice of violation with a warning, or a notice of violation with a penalty.
If an individual or a company receives a Notice of Violation, they may request a review of the facts. The review is made by the Minister of Agriculture and Agri-Food Canada and/or the Canada Agricultural Review Tribunal. The review can also go the Minister and then to the Review Tribunal.
